These Terms of Service (“Terms”) govern the use of the website and services provided by ROI Property Services Inc. (“ROI Property Services,” “we,” “us,” or “our”). By accessing this website or engaging our services, you agree to these Terms.
1. Nature of Services
ROI Property Services Inc. provides property oversight, maintenance coordination, project coordination, and operational support services.
Unless expressly agreed to in writing, ROI Property Services Inc. does not act as:
- A licensed property manager
- A rental agent
- A statutory trustee
- A holder of tenant trust funds
- A real estate brokerage
We do not provide services requiring licensing under provincial real estate or property management legislation unless separately contracted and legally authorized.
The specific scope of services is defined in individual written service agreements.
2. Independent Contractor Status
ROI Property Services Inc. operates as an independent contractor. Nothing in these Terms creates a partnership, joint venture, fiduciary relationship, or agency relationship unless expressly agreed in writing.
3. No Legal, Financial, or Engineering Advice
Information provided through our website or services is for coordination and operational support purposes only and does not constitute legal, financial, tax, engineering, or regulatory advice.
4. Third-Party Contractors
We may coordinate with independent third-party contractors or service providers. These third parties are not employees or agents of ROI Property Services Inc.
We are not responsible for the acts, omissions, pricing, delays, performance standards, or workmanship of third-party providers.
5. Client Responsibilities
Clients are responsible for:
- Providing accurate and complete property information
- Ensuring lawful and safe access to properties
- Maintaining appropriate insurance coverage
- Complying with all applicable laws and regulations
- Obtaining required permits or regulatory approvals
Delays, losses, or additional costs resulting from inaccurate or incomplete information remain the client’s responsibility.
6. Fees and Payment
Fees, billing structures, retainers, and payment terms are defined in written service agreements or invoices.
Unless expressly contracted in writing, ROI Property Services Inc. does not collect, hold, or administer tenant rents or security deposits.
Late payments may result in suspension or termination of services.
7. Limitation of Liability
To the fullest extent permitted by applicable law, ROI Property Services Inc. shall not be liable for indirect, incidental, special, or consequential damages, including loss of income, loss of rental revenue, business interruption, or damages resulting from third-party actions.
Our total liability, if any, shall not exceed the total fees paid for the specific service giving rise to the claim.
8. Website Use & Intellectual Property
All website content, branding, logos, text, and materials are the property of ROI Property Services Inc. and may not be reproduced without written consent.
9. Compliance & Safety
Clients and third-party providers must comply with all applicable safety standards, building codes, tenancy laws, environmental regulations, and controlled substance laws.
10. Governing Law & Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
If services are provided outside British Columbia or outside Canada, the applicable laws of that jurisdiction may also apply, but British Columbia shall remain the primary jurisdiction unless otherwise agreed in writing.
11. Amendments
We reserve the right to update these Terms at any time. Changes take effect upon posting.
